1. Acceptance of Terms

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all services offered by aethosna, including Subscription Management Tracker, Construction Project Finance Tracking, and Estate Organization Service.

2. Definitions

For purposes of these Terms:

• "Services" refers to all financial organization services provided by aethosna
• "User" refers to any individual or entity accessing our services
• "Content" refers to information, data, text, reports, and other materials provided through our services
• "Agreement" refers to these Terms and any additional agreements between you and aethosna
• "Account" refers to your registered user account with aethosna

3. Eligibility and Account Requirements

3.1 Age and Capacity

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our services. By using our services, you represent and warrant that you meet these requirements.

3.2 Account Registration

To access our services, you must create an account by providing accurate, current, and complete information. You agree to maintain and promptly update your account information to keep it accurate and current.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized access or security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Service Description

aethosna provides AI-assisted financial organization services designed to help users track subscriptions, monitor construction project finances, and organize estate information. Our services:

• Provide information organization and tracking capabilities
• Generate reports and insights based on your financial data
• Monitor patterns and alert you to relevant changes
• Organize information for professional consultations

Important Limitations: Our services provide organization and information support only. We do not provide financial advice, legal advice, accounting services, or investment recommendations. You should consult with appropriate licensed professionals for such services.

5. User Responsibilities

5.1 Permitted Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or attempt unauthorized access
• Interfere with or disrupt service functionality
• Use services for fraudulent purposes
• Impersonate others or provide false information
• Reverse engineer or attempt to extract source code

5.2 Data Accuracy

You are responsible for ensuring the accuracy of information you provide. While our AI systems work to identify and organize financial data, you should verify information accuracy and report any discrepancies promptly.

5.3 Professional Consultation

You acknowledge that our services provide information organization only and that you should consult with qualified professionals regarding financial decisions, legal matters, and estate planning.

6. Payment Terms

6.1 Fees and Billing

Services are provided on a monthly subscription basis at the rates specified during enrollment. All fees are in Singapore Dollars (SGD) unless otherwise stated. You agree to pay all applicable fees for the services you select.

6.2 Payment Methods

Payment is processed monthly in advance through your selected payment method. You authorize us to charge your payment method on the recurring billing date. You must maintain valid payment information to continue service access.

6.3 Price Changes

We reserve the right to modify service fees with 30 days' advance notice. Continued use of services after the effective date of a price change constitutes acceptance of the new pricing.

6.4 Refund Policy

Services are billed monthly in advance. If you cancel during a billing period, you retain access through the end of that period but no prorated refunds are provided for partial months. Refunds may be considered on a case-by-case basis for service failures or technical issues preventing reasonable use.

7. Intellectual Property

7.1 Company Ownership

All intellectual property rights in our services, including software, algorithms, designs, trademarks, and content, are owned by aethosna or our licensors. These Terms do not grant you any ownership rights in our intellectual property.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for their intended purpose during your subscription period. This license terminates upon service cancellation or termination.

7.3 User Data

You retain ownership of your financial data. By using our services, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing services. This license terminates when you delete your data or terminate your account, subject to our data retention obligations.

8. Service Availability and Modifications

We strive to maintain high service availability but cannot guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice. We will provide advance notification of material changes that affect service functionality.

9. Disclaimers

SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of information
• Warranties of uninterrupted or error-free service

We do not warrant that our services will meet your requirements or that results obtained from service use will be accurate or reliable. You use our services at your own discretion and risk.

Our services provide information organization tools, not professional advice. We make no representations regarding the suitability of financial decisions based on information organized through our services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, aethosna SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

• Your use of or inability to use our services
• Any unauthorized access to or alteration of your data
• Financial decisions made based on information organized through our services
• Service interruptions or errors

Our total liability to you for any claims arising from these Terms or service use shall not exceed the amount you paid for services during the twelve months preceding the claim.

Some jurisdictions do not allow limitation of certain warranties or liabilities, so some limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless aethosna and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your use of our services
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations

12. Termination

12.1 Termination by User

You may terminate your account at any time by providing notice through your account settings or by contacting customer support. Termination becomes effective at the end of your current billing period.

12.2 Termination by Company

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other legitimate business reasons. We will provide reasonable notice when possible.

12.3 Effect of Termination

Upon termination, your right to access services immediately ceases. We will provide a reasonable period (30 days) for you to export your data. After this period, we may delete your data in accordance with our retention policies.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or service use shall be subject to the exclusive jurisdiction of the courts of Singapore.

13.3 Informal Resolution

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and aethosna regarding service use.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Notices

Notices to you may be provided via email to your registered address or through service notifications. Notices to us should be sent to [email protected].

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or service notification at least 30 days before the effective date. Continued use of services after the effective date constitutes acceptance of the modified Terms.

If you do not agree to modified Terms, you may terminate your account before the effective date.
